my story is not about the 1980s witch hunt,but it still deals with kern county.My son was charged with sexual assult and discribed as a short mexican.However he is over 6 foot and is very white blue eyes anyhow he went to prison on plea bargainl deal not to have to register when he got out.however he has ever since because they went back retroactive to 1940s.Somehow nothing is showing in court record of no registration on his case and the attorney is now a comissioner.
I found the internet that has a form where you wont be seen on the internet websight for megans law and he is not on that.I took it opon myself to print the form and soon as the justice department recieved it he was no longer on it.The trick was no body knew you can do that.This all took place in the late 1990s and he has been off parole 10 years as of December 2007.I have started the process for him reguarding the pardon . First part not even done but public defender says it is close .Started that Feb or March 0f 2008.Then when that is compleated then it will go to the govenor.After all that he will still have to register.If only we had got that on one of the court documents.H e has not been in trouble since that time,but who ever it happens to get it all in writing.We just thought when the lawyer said that and went before the judge it would all be on documents.In the begining my son was looking at 25 years so he took the deal.no registration and 3 years probation.Oh and did I mention this was a friends girlfriend and the friend at the time didnt like him so why not have her blame him and she was over 18 years old. At this point he still will have to register as a sex offender,but at least he is not on the megans law websight.I hope by now people know about the form for you not to be on that if you are under certain guidelines ,if not I can pass the information along.thank you
